1. The grievance of the petitioners in the present writ petition is the inaction on the part of the respondents in not releasing the death cum retiral benefits payable to the petitioner on the death of her husband.

2. According to the petitioner, her husband was working as Attendant GradeIII under the respondents who dies in harness on 18.07.2013. Though, more than 7 years have passed till date death cum retiral benefits payable to the legal heirs of the deceased employee has not been settled.

Given the said submissions that petitioner has made in the writ petition, this Court considering the nature of the relief sought for would not like to admit the writ petition and call for reply of the respondents, rather ends of justice would meet if the writ petition is disposed of directing the respondent no.2 to 4 to take an appropriate decision in respect of the claim of the petitioner for release of death cum retiral benefits at the earliest preferably within an outer limit of 90 days from the date of receipt of copy of this order. The petitioner also is expected to complete all requisite formalities for obtaining all the retiral dues, if any within the stipulated period.

In case, if the undisputed payable dues are not released within the aforementioned period of 90 days the entire dues payable shall carry interest at the rate of 10% per annum from the date of death of deceased employee till the date of actual payment. The interest part would also be recoverable from the erring officials who have not processed the claim of the petitioner promptly.

5. With the aforesaid observations, the present writ petition accordingly stands disposed of.
