1. Heard.

2. The trial Court has acquitted the accused of the charges under Sections 363, 366 and 376(1) of IPC.

3. Father of the prosecutrix lodged the FIR stating that her daughter has eloped with some person. In the case diary

CRMP No. 597 of 2013 statement of the prosecutirx, she has informed the Police that she was in an affair with the accused for about 3-4 years. In her Court statement, she admits that in the night, on the date of the incident, she and her mother left the room and then, she went to the Railway Station to board the train for proceeding to Kharsia and thereafter, she went to Delhi with the accused. They had stayed together for 6-7 months while earning livelihood in Delhi. She admits that she did not complain to any person either during her train journey or during her stay at Delhi even though she used to meet the Policemen at the workplace.

4. Even though the prosecutrix was less than 18 years of age on the date of the incident, her conduct and the delay in lodging the FIR have rightly been found sufÏcient by the trial Court to acquit the accused.

5. No case for grant of leave to appeal is made out.

6. The CRMP is dismissed.
