This appeal is preferred under Section 374 (2) of the Code of Criminal Procedure, 1973 against judgment dated 11.11.2019 passed by Sessions Judge, Balrampur at Ramanujganj (C.G.) in Session Trial No. 66/2018, wherein the said court convicted the appellant for commission of offence under Sections 376 & 506 (Part-II) of IPC, 1860 and sentenced to undergo R.I. for 7 years and fine of Rs. 500/- & R.I. for 3 months and fine of Rs. 500/- respectively with further default stipulations. 2.
The appellant has already preferred an appeal against the impugned judgment which is registered as CRA No. 1771 of 2019. As the appeal on merit has already been preferred, this appeal which is subsequent appeal against the same impugned judgment, is not maintainable.

Accordingly, this appeal is dismissed as not maintainable. However, counsel for the appellant is permitted to assist in CRA No. 1771 of 2019 for the appellant and he may file memo of appearance in the said appeal.
