1. On due consideration delay of 29 days occurred in filing of the Cr.M.P. is condoned. Accordingly, I.A. No.01/2020, for condonation of delay is allowed.

2. The trial Court has acquitted the accused of the charges under Sections 363, 376 of the I.P.C. and under Sections 3, 4 of the Protection of Children from Sexual Offences Act,

CRMP No. 247 of 2020 2012.

3. Considering the statement of the prosecutrix and her parents as also considering her age, we are inclined to grant leave to appeal against acquittal.

4. Accordingly, the Cr.M.P. is allowed.

5. Let regular acquittal appeal be registered and the same be posted for consideration in the next week.
