Agrawal Order On Board 11/01/2018 (1) Learned counsel appearing for the petitioner would submit that the petitioner's appeal against the order dated 12.07.2017 is pending before respondent No.4-Director, Directorate of Geology and Mining, Raipur since July, 2017 and the same has not been considered and decided till this date and Collector, Balodabazar has refused to decide the petitioner's representation as directed by this Court by order dated 01.11.2017 passed in WPC No.2892/2017, against which this writ petition under Article 226 of the Constitution of India has been filed. (2) Learned counsel appearing for the State/respondents would submit that the petitioner's appeal will be considered and decided by the respondent No.4 expeditiously.

(3) Be that as it may, respondent No.4 is directed to consider and decide the appeal of the petitioner in accordance with law expeditiously within a period of 45 days from the date of receipt of certified copy of this order and depending upon the result of order passed by the respondent No.4. The petitioner is at liberty to make fresh representation before the Collector, Balodabazar as directed by this Court on 01.11.2017.

(4) With the aforesaid observation, the writ petition stands finally disposed of.
