1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 09.04.2020 in connection with Crime No.102/2020 for offence under Section 34 (2) of the C.G. Excise Act, registered at Police Station- Berla, District- Bemetara (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3) Counsel for the State submits that number of cases against the present applicant are pending.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
