Hon'ble Shri Justice P. Sam Koshy Order On Board 10/07/2015 By way of the present petition, the petitioner has sought for relief of granting promotion from the date of his juniors having been promoted to the post of Asstt. Grade-II.

It is pertinent to mention in paragraph-8.11 of the writ petition, the petitioner has specifically cited the case of one UP. Singh, who was junior to the petitioner to have been granted promotion to the post of Asstt. Grade-II w.e.f 16.9.1980 vide the order dated 16.8.1983 of the High Court of Madhya Pradesh in Petition No.1031/1981.

To the said contention of the petitioner, the respondents while filing reply to the said paragraph-8.11, have categorically stated that they do not dispute the contention so raised by the petitioner. Thus, it is clear that the State is admitting the contention put forth by the petitioner. 4.
Thus, in the light of the stand taken by the State Government in their return, this Court is of the view that ends of justice would meet if the
petition is disposed of with a direction to the State Government to consider the case of the petitioner in parity with that of Shri U.P. Singh who has been granted the relief vide order dated 10.7.2008. 5.
In case the State finds that the case of the petitioner is similarly placed as that of Shri U.P. Singh, he shall also be entitled for the grant of relief at par with that of Shri U.P. Singh.

With the aforesaid observation, the instant writ petition stands disposed of.

It is expected that since the petitioner by now has crossed the age of superannuation, the State Government would take prompt and expeditious decision on the claim of the petitioner. Sd/- J U D G E Priya
