1. Learned counsel for the petitioner would submit that petitioner is the widow of late Shri R.S. Chaturvedi who died on 03/10/2012 and is entitled for monetary benefits along with the arrears of senior grade and selection grade with effect from the date of completion of 8 years of service from the date of her husband's absorption in the Government Polytechnic College and thereafter from the further completion of 8 years of service on senior grade, which ought to have been given to her husband extending the benefit of grant of senior scale and selection grade in light of the Government circular as per the decision passed by the Madhya Pradesh High Court in the matter of Abdul Majid Khan v. State of Madhya Pradesh1 (Annexure P/9), for which the petitioner has also made representation (Annexure P/8) but that has not been considered.

2. Learned State counsel would submit that petitioner's representation (if any) will be decided in accordance with law.

3. I have heard learned counsel for the parties at length.

4. Be that as it may, respondents No. 1 and 2 are directed to consider and decide petitioner's 1 WPS No. 1297 of 2005 decided on 02/09/2008

representation within six weeks from the date of receipt of a copy of this order by passing a reasoned and speaking order. Petitioner is at liberty to make additional representation within three weeks from today. It is made clear that this Court has not expressed any opinion on the merits of the matter.

5. Accordingly, this writ petition stands disposed of. No cost(s).
