Challenge in this petition is to the order dated 28.04.2012 whereby the Respondent No.6 was appointed as Oath Commissioner. 2.

As per the Reply of Respondent No.2 & 3, according to Rule 7 of the Commissioner of Oath Rules, 1976, the appointment was made only for three years.

Since the appointment was only made for three years, by efflux of time, the order dated 28.04.2012 shall automatically come to an end; therefore, the petition has become infructuous by the efflux of time. The petitioner shall have a liberty to challenge the further cause of action if it is accrued in favour of the petitioner.
