1. Mr.Vinod Kumar Sharma, learned counsel for the petitioner, would submit that the petitioner's representation dated 25.6.2012 has not been decided by respondent No.2 by passing a reasoned and speaking order and in most casual manner, it has been rejected, as such, the petitioner may be allowed to make a fresh representation to respondent No.2 for her seniority.

2. Mr.Aninesh Tiwari, learned Deputy Advocate General for respondent No.1 and Mr.A.S.Kachhawaha, learned counsel for respondent No.2, would submit that if such a representation is made, that will be considered and decided by the respondents-authorities in accordance with

law by passing a reasoned and speaking order.

3. Be that as it may, the petitioner is at liberty to make a representation qua her seniority within 3 weeks from today to respondent No.2. If such a representation is made, respondent No.2/Municipal Corporation, Durg shall consider and decide the same strictly in accordance with law and to pass a reasoned and speaking order within 6 weeks from the date of receipt of representation.

4. With the aforesaid observation / direction, the writ petition finally stands disposed of. No order as to cost(s).
