As per communication, appellant Narsingh Chouhan was admitted in CIMS Bilaspur on 12.10.12 and during treatment he died on 17.10.2012.

As the sole appellant died on 17.10.2012 and no any application from any of his near relatives has been preferred to contest the appeal on its merits, the instant criminal appeal stands abated on account of death of sole appellant under Section 394(1) of the Cr.P.C. 4.

The appeal is dismissed as abated.
