Learned counsel for the petitioner would submit that father of the petitioner died in harness during his period of service in the year 1197 and Municipal Corporation, Chirmiri has neither paid provident fund nor paid gratuity and even not considered the application for compassionate appointment of the petitioner till this date.

Be that as it may, respondents are directed to consider the case of the petitioner in accordance with law with regard to provident fund, gratuity and compassionate appointment within a

period of 45 days from the date of receipt and/or production of certified copy of this order.

With the aforesaid direction, writ petition is disposed off. It is made clear that this Court has not expressed any opinion on the merit of the case.
