Counsel for the petitioner makes an oral prayer for amendment in the writ petition.

Accordingly, the oral prayer is accepted. Let necessary amendment be carried out during the course of the day.

The dispute in the instant Writ Petition is in respect of difference of pay which the petitioner would be entitled for during the period 23/09/2008 to 10/05/2011.

The actual dispute which the petitioner is aggrieved of is that, the petitioner though was working as an Electrician under the respondent No.3, but he was paid the wages of Siksha Karmi-Grade-III i.e. the scale of 3800-5800/- whereas the scale of pay for the Electrician cadre was in fact 3,050-4,590/-.

According to the counsel for the petitioner, the petitioner had brought this fact to the notice of the authorities in the department who immediately rectified the pay-scale granted and from 11/05/2011 onwards, the petitioner is being paid the pay-scale of 3,050-4,590/- and that now the only dispute remains is that of arrears of difference of pay for the period between 23/09/2008 to 10/05/2011. He further contended that, the petitioner has been repeatedly approaching the authorities in the department, but no relief has been given to the petitioner by the respondent and the representation also till date has not been rejected in any manner.

Given the aforesaid facts and circumstances of the case, let the respondents No. 1 & 2 take a decision on the entitlement of the petitioner so far as the arrears of pay is concerned for the aforesaid period and in this regard the respondents No. 1 & 2 pass an appropriate order at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.
