Learned counsel for the petitioner would submit that the petitioner was appointed by the Executive Engineer/respondent no.2 on daily wages and subsequently his services was discontinued. When the information under the Right to Information Act was obtained, it shows that he was appointed on oral order and daily wage amount has been paid.

It is contended that the service of the petitioner was dispensed with without giving any opportunity to him.

A perusal of Annexure P-1 would show that in order to adjudicate the disputed questions, the facts and evidence are required to be gone into. Therefore, in exercise of power under Article 226 of the Constitution of India, I am not inclined to entertain this writ petition. Accordingly, it is dismissed.

However, the petitioner, if so advised, shall be at liberty to avail the remedy before appropriate forum.
