The present petition is filed for the reason that the land of the petitioner bearing Khasra No.997/1 situated at village Akalatara was acquired. It is stated that the road was constructed for Ward No.18 by the Municipal Council Akalatara without acquisition of land or payment of any compensation to the petitioner.

The reply of the State and Municipal Council would show that the resolution has been passed for giving compensation to the petitioner in lieu of the acquisition of the land and necessary procedure as per law would be commenced by the Municipal Council and will be communicated to the State
Government and the State Government would take appropriate action in the matter.

Both the counsel appearing for the State & Respondent No.4 i.e. Municipal Council have reiterated the similar facts.

In view of this, since the respondents have already resolved to acquire the land of the petitioner by giving compensation, the procedure for compensation may be initiated and should be concluded within a reasonable period of time. The initiation of proceeding of acquisition may be done within a period of 90 days from the date of receipt of a copy of this order.
