Learned counsel appearing for the State/respondent filed photocopy of a communication received from Inspector, SHO, Ratanpur, District Bilaspur, C.G. vide communication No.281/2015 dated 01-05-2015 along with other annexed document and attested photocopy of the death certificate and submitted that sole appellant Dhaniram Suryavanshi S/o Ram Manohar Suryavanshi R/o Bhedimuda, Khaiyapara, Ratanpur has died on 03-08-2014 at Kewachi. His death was registered on 22-08-2014 vide registration No.05 before the Registrar, Birth and Death, Village Panchayat Kewachi, Tahsil Pendra Road, District Bilaspur.

As the sole appellant died, no any application to contest the instant appeal preferred on behalf of his near relatives before the Court within stipulated time, the appeal filed on behalf of the appellant stands dismissed as abated under provisions of Section 394(1) of the Cr.P.C. 3.

The appeal dismissed as abated.
