Learned Counsel for the Petitioner submits that the grievance which he had agitated in the present writ petition is the notification dated 24.11.2009 (Annexure P-21) whereby the Respondents had issued an order holding during the period of probation the Probationers would not be entitled to apply for recruitment elsewhere till the probation period is completed.

This Court initially at the time of entertaining the petition vide order dated 2.12.2010 had granted an interim relief. According to the Petitioner, by efflux of time the issue raised by the Petitioner has now become

-2academic and the same may be left open and the present writ petition itself may be disposed of with a direction that in case the claim of the Petitioner is pending consideration, the disposal of the present writ petition may not be construed detrimental to the interest of the Petitioner by the concerned institution where he had applied for.

In view of the said submission, nothing further remains to be adjudicated upon leaving open the issue raised by the Petitioner to be agitated upon in an appropriate petition.
