16/09/2016 On 07.07.2016, a bailable warrant of arrest was issued against the appellant for securing his presence before this court today i.e. 16.09.2016.
A report dated 04.08.2016 has been received from the office of Station House Officer, Seepat, District Bilaspur, intimating that accused-appellant in the instant case Deepak Yadav, S/o late Vishram Yadav, R/o Village Nargoda, Tehsil Masturi, Distt. Bilaspur, has since expired on 31.05.2015. Death certificate of Deepak Yadav is also enclosed along with the report of SHO, Seepat, in this regard. In view of the above, in the opinion of this court, nothing further remains to be adjudicated upon in the present case as there is no representation on behalf of any legal heir interested to further prosecute the appeal. Accordingly, the Criminal Appeal is dismissed as abated.
