1. The appeal against acquittal has been filed by father of the deceased, who is a victim, as defined under Section 2 (w)(a) of the Cr.P.C.

2. No leave is required in view of judicial pronouncement of Supreme Court in the case of Mallikarjun Kodagali (Dead)

represented through Legal Representatives Vs. State of Karnataka & Others decided on 12.10.2018.

3. The appeal filed by the appellant be registered under the head "Acquittal Appeal" and be listed for further orders.

4. Accordingly, the CRMP is disposed of.

5. Meanwhile, issue notice to the respondents as per rules.
