The prayer sought for by the petitioner in the present Writ Petition is for grant of pensionary benefits and other retiral dues payable to the petitioner. 2.

The contention of the counsel for the petitioner is that the persons who were appointed subsequent to the petitioner being engaged by the respondents had been in due course of time regularized and thereby the petitioners claim has been overlooked by the respondents and therefore the

present Writ Petition has since been filed seeking appropriate directions in this regard.

Perusal of record would show that the petitioner stood superannuated from the services of the respondents on 31/05/2002. The present Writ Petition was filed on 04/03/2013 i.e. almost about 11 years after the date of crossing the age of superannuation.

Moreover, the petitioner all along while in service was not aggrieved by any decision of the State Government in respect of the juniors being regularized ahead of the petitioner.

Given the aforesaid facts and circumstances of the case this Court is of the opinion that the present Writ Petition suffers from delay and latches and the same deserve to be and is accordingly rejected. Sd/- (P. Sam Koshy) Sumit JUDGE
