The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 02/01/2021 in connection with Crime No. 77/2021 registered at Police Station Excise Circle Arang, District Raipur (C.G.) for the offence punishable under Sections 34(1)(A), 34(2), 59(A)(1)(2), 36 of C.G. Excise Act.

2. Learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh application as and when occasion arises.

3. Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
