Heard on I.A. No. 01/2018, an application for condonation of delay of 1535 days in filing this MCC.

The said application is not contested by the respondents, therefore after considering the reasons assigned therein, I am inclined to allow the same and the delay in filing this MCC is accordingly condoned.

Also heard on admission.

This MCC has been filed for restoration of MCC No. 320/2009, which was dismissed in default vide order dated 12.04.2012 passed by this Court.

For the reasons assigned in the application for restoration of the same, I am inclined to allow the same.

Accordingly, the instant M.C.C. is allowed and MCC No. 320/2009 is restored to its original number. No order as to costs.
