1. Heard.

2. During the course of argument, it transpired that in the original suit, the plaintiff evidence is already closed and the case is fixed for defendant evidence. In view of such submission made, the appeal is disposed of with a direction that the trial Court shall make all endeavour to decide the case within a further period of three months from the date of receipt of this order and shall not be influenced by any expression made while deciding the interim application.

3. It is made clear that at this stage this Court has not expressed any opinion on the merits of the case considering the nature and progress made in the case in the trial Court.
