Shri YS Thakur, Advocate for the respondents. The present contempt petition has been filed alleging non compliance of the order dated 19.08.2019 passed by this court in WPS No.5010 of 2015. Learned counsel for the respondents enters appearance and have produced a document to show that the order passed by this court has since been complied with, inasmuch as, the seniority has been refixed and the petitioner has been brought in the seniority list at serial No.29 as against the earlier seniority of the petitioner being at 651. This fact is not disputed by the counsel for the petitioner as well.

Given the said facts, the order passed by this court stands complied with. In case if the petitioner is aggrieved of non granting of any consequential benefits to the refixing of the seniority, the same would be a fresh cause of action to be claimed by the petitioner by way of a fresh petition. The same cannot be looked into in the context of the order passed by this court under the contempt jurisdiction.

Accordingly, reserving the right of the petitioner for availing appropriate remedies available to the petitioner for the said grievance, the present contempt petition in its present form stands disposed of. Sd/- (P. Sam Koshy) Inder Judge
