Smt. Anju Sahu W/o Shri Anil Kumar Sahu, aged about 29 years R/o Near Sarswati Shishu Mandir Pendra road, Gaurela, Tahsil & District Bilaspur Prtesent Address Sahu Aata Chakki Kailashpuri Chowk, Raipur (C.G.) ---- Respondent For Applicant :
Mr. S.B. Pandey, Advocate For Respondent :
None Hon'ble Shri Justice Arvind Singh Chandel Order on Board 19/02/2019 1.
Heard on admission.
2.
This revision has been preferred against order dated 24/12/2018 passed by the learned Second Additional Principal Judge, Raipur in Case No. 431/2017, whereby the learned Family Court granted interim maintenance of Rs. 8000/- in favour of the Respondent/Wife. 3.
This revision is preferred on the grounds that though the Respondent is legally wedded wife of him, she is residing separately without any reasonable cause, and also on the ground that she is living in adulterous life.
4.
There is no dispute on the point that the Respondent is legally wedded
wife of the Applicant. There is also no dispute on the point that the Applicant is working as Constable and is getting monthly salary of Rs. 25000/-. Whether the Respondent is living separately without any reasonable cause or not and whether the Respondent is living adulterous life or not, are the matter of evidence. Since, she is legally wedded wife of the Respondent, she is entitled to get interim maintenance. Therefore, the order of the Family Court granting interim maintenance of Rs. 8000/- in favour of the Respondent is just and proper.
5.
Considering the above, I do not find any merit in this revision. The revision is dismissed.
