Taking into consideration all the facts and the evidence adduced by the prosecution, this Court is of the opinion that it is a fit case where the instant Cr.M.P., filed under Section 378(3) of Code of Criminal Procedure deserves to be and is allowed.

Accordingly, leave to appeal as prayed for is granted. Registry is directed to register the instant case under the head of "Acquittal Appeal" and list the matter thereafter for admission after summer vacation along with Acquittal Appeal No. 151 of 2011.
