Learned counsel for the petitioner submits that the land of the petitioner bearing khasra No.192/1A admeasuring 0.040 hectare situated at village Bargarh was acquired for construction of the National highway. Though the amount of compensation was paid, however, the petitioner as per the Rehabilitation Scheme is entitled for a further amount of Rs.5,00,000/-. He referred to Annexure P-1 which is a correspondence of the policy of the State issued on 11.09.2015 and would submit that according to the policy, a person whose land is acquired is entitled for a package of rehabilitation of Rs.5,00,000/-. Therefore, the petitioner had made an application Annexure P-3 to the S.D.O. /Land Acquisition Officer, Kharsia, District Raigarh, which may be directed to be decided within a specified time.

Without any observation as to the merit of the claim of the petitioner, at this stage, since the prayer has been made to decide the application of the petitioner, it is directed that if the petitioner files a fresh application/ representation along-with the necessary relevant documents for rehabilitation amount of Rs.5,00,000/-, the concerned authority i.e. S.D.O./ Land Acquisition Officer, Kharsia is directed to decide the same within a further period of 90 days from the date of receipt of the representation.
