1. The learned counsel for the petitioner seeks permission of this Court to withdraw the present petition and file appeal against the impugned order under Order 43 Rule 1 of C.P.C. before the appropriate forum.

2. On the basis of the submissions so made by the learned counsel for the petitioner, this petition is dismissed as withdrawn.

3. The time spent in filing of this petition may be considered by the Court concerned, while condoning the delay in filing of the appeal under Order 43 Rule 1 of C.P.C. It is further ordered that the certified copy and documents filed along with the petition be returned to the learned counsel for the petitioner.
