Shri FS Khare, learned counsel for respondent- 2 submits that challenge in this petition is to the order dated 30.05.2017 passed by learned Sessions Judge, Kawardha, District- Kabirdham in Criminal Revision- 21 of 2017, whereby Revision filed by the petitioner against order dated 20.07.2016 passed by JMFC in Criminal Case- 122 of 2016, framing charge against petitioner was dismissed on the ground of limitation. Learned Magistrate during pendency of Revision, has concluded trial and passed judgment on 18.10.2021. Hence, by efflux of time, petition is rendered infructuous. 2.
Shri Barun Chakrabarty, learned counsel for the petitioner on instructions, admits that the Judicial Magistrate First Class/trial Court has already concluded trial and final judgment has been passed. 3.
