Agrawal Order On Board 13/11/2018 (1) By the impugned order dated 07.05.2015, plaintiffs' application for exhibiting certain documents has been rejected by the trial Court, against which instant writ petition has been filed questioning the same. (2) I have heard learned counsel appearing for the parties. (3) Since the aforesaid documents are said to be the public documents, therefore, the plaintiffs are allowed to exhibit those documents by examining plaintiffs' witness namely Ramnaresh Yadav (PW-1) on 26.11.2018.

(4) Parties are directed to appear before the trial Court on 26th November, 2018. On that day the trial Court would allow the plaintiffs to exhibit documents in accordance with law and for that purpose no further evidence will be allowed to the plaintiffs except exhibiting those documents subject to payment of cost of Rs.3,000/- to the defendants. The defendants will also be entitled to file rebuttal documents, if any and to lead evidence, if any.

(5) Since the civil suit is pending since 8.3.1997, the trial Court is directed to decide the suit expeditiously preferably by 31st December, 2018. (6) With the aforesaid direction, the writ petition stands disposed of. (7) Copy of this order be sent to the trial Court through concerned District Judge for compliance and needful by e-mail / FAX and directly also. Certified copy by tomorrow.
