1. Mr.Tarun Dadsena, learned counsel for the petitioner, would submit that though Lalit Nishad to whom compassionate appointment was given has died and the petitioner has made an application for compassionate appointment as per policy, which has not been considered and decided till this date.
2. On the other hand, Mr.Siddharth Dubey, learned Deputy Government Advocate for the respondents/State, would
submit that if fresh representation is made by the petitioner within 3 weeks from today that will be considered and decided by the respondents as per relevant rules applicable at the time of death of Lalit Nishad.
3. Be that as it may, the petitioner is allowed to make fresh application / representation for compassionate appointment within 3 weeks from today. If such an application / representation is filed, the same shall be considered and decided by the respondents authorities within 4 weeks from its receipt and to pass a reasoned and speaking order, strictly in accordance with law. It is made clear that this Court has not expressed any opinion on merits of the case.
4. With the aforesaid observation / direction, the writ petition finally stands disposed of. No order as to cost(s).
