1. Since the above bail applications arise out of the same crime number, they are being disposed of by this common order.
2. Both the applications are applicant's first bail application filed under
Page No.2 Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants who have been arrested in connection with Crime No.535/2017, registered at Police Station - Jutmil Chowki, Raigarh, District- Raigarh(C.G.) for the offence punishable under Sections 3, 4 & 5 of Immoral Traffic (Prevention) Act, 1956.
3. Learned counsel for the applicants submits that applicants are innocent and have been falsely implicated in this case. No case is made out against these applicants. The co-accused persons in this case have been granted regular bail by the co-ordinate Bench of this Court. Applicants are in jail since 9.9.2017 and they are ready to abide by all the conditions and directions, which may be imposed while granting bail to her. Hence, it is prayed that she may be released on bail.
4. Learned State counsel opposes the bail application and submissions made in this respect.
5. Heard both the parties and perused the case diary.
6. A raid was conducted by police personnel of PS-Jutmil Chowki, Raigarh, on the spot of incident when the raid was conducted it was found, that other co-accused persons were in objectionable condition. Hence, the offence of immoral trafficking has been registered against the applicants and other co-accused persons.
7. As the case is presently before the trial Court and the trial against this applicants is likely to take some time before its conclusion and, further, the co-accused persons have been granted bail by the co-ordinate Bench of this Court, I feel inclined that applicant should be granted regular bail during the pendency of the trial against them.
8. Accordingly, the bail application filed under Section 439 of Cr.P.C. is
Page No.3 allowed. It is directed that the applicants shall be released on bail on their furnishing a personal bond for a sum of Rs.25,000/-each with one surety in the like sum to the satisfaction of the concerned trial Court, for their appearance as and when directed.
