1. Learned State counsel submits that the sole appellant Bandhan has died and no application has been filed by any of the legal heirs of the deceased appellant.

2. Death certificate of deceased appellant Bandhan issued by Gram Panchayat, Bedopani, PS, Lakhanpur, has been produced and the same is taken on record wherein it has been stated that the appellant Bandhan died on 15-1-2015.

3. In view of the above the instant appeal has become abatted and it is accordingly dismissed as having become abatted. Sd/- (Goutam Bhaduri) Judge Raju
