The grievance of the petitioner in the present writ petition is the non-consideration of the claim of the petitioner for promotion from the post of Sub-Inspector (Special Branch) to Inspector (Special Branch).

According to the petitioner, she was appointed on the post of SubInspector (Special Branch) in the year 2013 and till now she is working on the post of Sub-Inspector. The next promotional post of
the petitioner is that of Inspector (Special Branch). According to the petitioner, the minimum length of service required for usual promotion is 8 years. However as per the promotion policy of the State Government, an employee/officer, who has worked on the post of Sub-Inspector in a scheduled area for a period of 4 years, would get a relaxation of one year for the purpose of counting the total length of service for promotion. That if the said relaxation is given to the petitioner, she becomes eligible for promotion as she would complete 7 years of service. According to the petitioner, the Department has also accepted this contention and had called for the service records and past ACRs of the petitioner, however thereafter there is no further development.

Given the aforesaid contentions that the petitioner has raised, the writ petition at this juncture can be disposed of directing the respondents 2 to 4 to immediately process the claim of the petitioner in respect of her claim for promotion and consider whether she would be entitled for promotion at this juncture taking into consideration the circular of the State Government granting relaxation of one year, so far as counting the total length of service required for promotion and an appropriate decision be taken at the earliest preferably within a period of 90 days from the date of receipt of the copy of this order.

With the aforesaid observations, the present writ petition stands disposed of.
