Heard Learned Counsel for the Petitioner and the State. 2.

The termination was ordered as far back as 2004 after departmental proceedings on ground of securing appointment on a wrong caste certificate claiming to be a Scheduled Tribe. The appeal against the same was also dismissed on 14.9.2004 and the mercy appeal was also dismissed on 6.9.2006. 3.

Learned Counsel for the Petitioner sought to persuade the Court that the Petitioner had handed-over the papers for institution of a writ petition to a Counsel in 2007, but he did not do so and the papers were made available to him only in 2011 after intervention of the State Bar Council.

Even if that explanation is considered, the Petitioner has not alleged any procedural irregularity in the conduct of the departmental proceedings to warrant interference. The jurisdiction of this Court against an order of punishment in a departmental proceeding is limited to examining errors in decision making process. Learned Counsel for the State has also invited attention of the Court to the deposition of the Petitioner in the departmental proceedings acknowledging that he did not belong to the Scheduled Tribe. 5.
