The relief sought for by the petitioner in the present writ petition is for an appropriate direction to the respondents for passing an appropriate order for appointment to the post of Assistant Professor (Chemistry). 2.

The contention of the petitioner is that the petitioner had applied for the recruitment to the post of Assistant Professor under the Department of Higher Education from the advertisement that was published in the year 2014. The petitioner was found eligible and got selected for the post of Assistant Professor in the subject Chemistry, as she has secured 93.74 marks and the name of the petitioner appeared in the select list at serial No. 53 against a reserved post of scheduled caste female category. 3.

The contention of the petitioner is that the selection or appointment of the petitioner is not in dispute in any of the writ petition before this Court and that the reference to a writ petition preferred by one Smt. Poonam Thawait (WPS No. 6245/2018) is concerned, that was in respect of a challenge of a

-2candidate from the open unreserved category and the said challenge in any manner would not come in the way of the appointment to be granted to the petitioner.

The State counsel submits that since there is a litigation in respect of the same select list pending before this Court, the State Government must not have issued the appointment order to the petitioner. 5.

Given said fact, subject to the verification whether there is any dispute pending before any forum including the High Court, so far as the appointment or the merit of the petitioner is concerned, the respondent/State Government would be free to proceed further with the recruitment and in case if there is no such proceeding or dispute pending so far as the selection of the petitioner is concerned, the respondents would be free to take appropriate decision at the earliest within a period of 60 days subject to verification of the aforesaid facts.

With the aforesaid observations, the present writ petition stands disposed off.
