The Petitioner has moved this Court with the following prayers: "10.1 That, this Court may kingly be pleased to direct the respondent CMDC to accept the Demand Draft (Annexure P/3) of petitioner even after 15.01.2021 and allow him to participate in the tender process of NIT dated 04.01.2021 (Annexure P/2), in the interest of justice.

OR This Hon'ble Court may kindly be pleased to set aside the tender process of NIT dated 04.01.2021

(Annexure P/2) and direct the respondents to issue fresh tender, removing clause of depositing demand draft of Rs.59000/- in the name of respondent CMDC payable at Raipur in office of respondent CMDC as mandatory clause for participating in tender process, in the interest of justice.

10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given."

After filing the writ petition I.A. No. 2 of 2021 has been filed seeking for withdrawal of the writ petition.

In the light of the prayers sought for in the said I.A., the writ petition stands dismissed as withdrawn.
