1. Heard on application for condonation of delay in filing appeal.

2. Even if we are inclined to condone the delay, we find that the appeal is bereft of any merit. Judgment and decree has been passed against the appellant in the matter of custody of minor child who is hardly two and half years of age.

3. Looking to the need of an infant child, we do not consider it proper to grant custody of the minor child to the appellant-father. We do not find any illegality in the matter.

4. The appeal is accordingly dismissed.
