Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 13-21. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.
2. The applicant has been arrested in connection with Crime No. 107/2018 registered in police station Pakhanjur, Distt. North Bastar, Kanker (CG) for offence punishable under Section 419, 420, 34 of IPC and S. 66 of the Information and Technology Act.
3. Prosecution story in brief is that the applicant is account holder of Account no. 4853101002222 of Canara Bank. He received an e-mail that one Box containing Dollar and Gold would be sent to him from Syria, the he would have to pay custom duty. Thereafter he received a telephonic call from No. 8750092076, the caller told that he is from custom office. One parcel has come. He had to pay Rs. 1,30,000/- as custom duty. He had deposited that amount in said account number. Thereafter he received another telephonic call that in that box, there are foreign currency notes and a case under money laundering would be registered. If he wants to save himself, deposit Rs. 3,75,000/- in the same account number and he again deposited the said amount in that account. Thereafter some
caller again demanded Rs. 1,39,200/- for R.B.I. Approval.
4. Counsel for the applicant argued that the applicant is innocent and has been falsely implicated hence he be released on bail.
5. On the other hand, the State Counsel opposed the bail application. He further submits that no criminal antecedent has been reported against applicant in the police case diary.
6. Looking to the above facts and circumstances of the case, as the trial will take its own time, the application is allowed. It is ordered that if the applicant furnishes two solvent sureties each for a sum of Rs. 25,000/- along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that he will not involve himself in any of the crime in future, he be released on bail.
