This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.
The applicants have been arrested in connection with Crime No. 03/2019 registered at Police Station- Sankara, District- Mahasamund (C.G.) for the offence punishable under Section 20(B) of NDPS Act.

Case of the prosecution, in brief is that on 07.01.2019 Inspector Veena Yadav posted at Police Station Sankara, seized 4.050 Kg cannabis from the possession of the applicant No.1 Vasudev Sande and two notes of denomination hundred rupees from the possession of the applicant No.2, Anil Sidar who accompanied to applicant No.1.

Counsel for the State submits that there is no criminal antecedent of the applicant is reported in police case diary.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if each applicant furnishes one solvent surety for a sum of Rs. 25,000/- along with one personal bond of Rs. 25,000/- to the satisfaction of the trial Court concerned, he be released on bail. 7.
