Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court by the applicant for grant of regular bail. The applicant has been arrested on 22-11-2017 in connection with Crime No.02/2017 registered at P.S. Jainagar, District Surajpur, Chhattisgarh for the offence under Section 419, 420, 467, 468, 471 and 120B of the IPC. 2.

It is submitted on behalf of the applicant, that the applicant has been falsely implicated in this case. The applicant is in jail since 22-11-2017 and has a child of one year, who is also in jail along with her. Co-accused persons in this case have been granted bail by this Court and coordinate Bench of this Court. The applicant has similar case. Hence, it is prayed that she may be granted bail.

Learned counsel for the State/non-applicant opposes the application. 4.

Heard learned counsel for both the parties and perused the case diary. 5.

The applicant was working as Rojgar Sahayak in Gram Panchayat Kanakpur along with co-accused persons. A forged muster roll was prepared showing the name of complainant - Mohar Lal Rajwade and Lalman Rajwade

-2and the remuneration of the labour work was withdrawn showing the forged signatures of receipt on the muster roll and the same was misappropriated by this applicant and other co-accused persons. The amount of defalcation was Rs.5,724/- and Rs.7,000/-. Charge sheet has been filed after completion of the investigation.

Considered the submissions made and contents of the case diary. As the co-accused persons in this case have been granted bail by this Court and coordinate Bench of this Court, I am of this view that this applicant also deserves to be released on bail during pendency of trial of this case. 7.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for her appearance as and when directed. 8.
