Learned counsel for the petitioner would submit that this petition is against the removal of the petitioner from service. It is stated that the petitioner was appointed in lieu of the fact that the land of the family of the petitioner was acquired and he was given appointment.

Learned counsel for the respondents, at the outset, would submit that as per the certified standing order of the SECL, the appeal is provided.

In view of this, the petitioner, at this moment, prays that he may be allowed to withdraw this petition to avail the departmental appeal as provided under certified standing order.

In view of the above, the petition is dismissed as withdrawn. The liberty is given to the petitioner to file an appeal within a period of 30 days from today. The petitioner may approach this Court as and when further cause of action arises in future. Sd/- (Goutam Bhaduri) JUDGE ashok
