This is an application filed under Section 439 Cr.P.C. for grant of bail to the applicant, who has been arrested in connection with Crime No.405/2017 registered at Police Station Ambikapur, District Surguja (C.G.) for the offence punishable under Section 20(B) of Narcotic Drugs and Psychotropic Substance Act, 1985.

The present applicant is in jail since 09.07.2017 in connection with the aforesaid Crime number.

The counsel for the applicant submits that, it is a case where the present applicant has been falsely implicated and that the coaccused in the instant case Jabbar Ansari has already granted bail by this Court in MCRC No. 7566/2017 and thus prayed for releasing the applicant on bail.

The State counsel however opposing the bail application submits that, the allegation levelled against the present applicant is serious in nature and thus prayed for rejection of bail application.

Having heard the contention put forth on either side and on perusal of record what reflect is that, for the same allegation and under similar circumstances, the co-accused Jabbar Ansari has already been released on bail by this Court vide order dated 30/01/2018 in MCRC No.7566/2017. Since the allegations against the applicant are identical in nature, this Court is of the opinion that the present applicant also deserve for the benefit of bail on the ground of parity. 6.
Accordingly, the application for grant of bail is allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court for his appearance before the said Court as and when directed.
