01/03/2019 Shri Abhijit Sarkar, counsel for the petitioner. Heard on IA No. 01/2019 for condonation of delay in filing the instant CrMP. This petition is preferred against judgment dated 11.04.2016 passed by Chief Judicial Magistrate, Korba in Criminal Case No. 388 of 2014. It appears that earlier appeal was filed against the said judgment before the Sessions Judge, Korba which was registered as Criminal Appeal No. 57 of 2016 and it was pending from year 2016 to 05.10.2018.

Looking to the time spent in earlier appeal filed before Sessions Judge, delay of 911 days is condoned.

Also heard on application for leave to appeal under Section 378 (4) of the CrPC.

On due consideration, leave is granted.

Let the CrMP be registered as regular Acquittal Appeal. Admit.

Issue notice to the respondent payment of PF within two weeks. Notice be made returnable within six weeks.
