Hon'ble Shri Justice Goutam Bhaduri Order On Board 02.02.2021 Heard.

1. Learned counsel for the petitioner submits that the petitioner was granted a permit for Bijapur to Bilaspur route by order dated 19.12.2019 (Annexure P1). However, till date the physical permit has not been issued for the reason that the entire authority has been presently vested with Single Regional Transport Authority, C.G. (Respondent No. 3). It is further submitted that the petitioner was not noticed/informed of the order dated 19.12.2019, which came to his knowledge subsequently. Therefore, after it came to the knowledge of the petitioner the petitioner though applied for issuance of permit by Annexure P-2 the same has not been issued.

2. Learned State counsel, on the other hand, would submit that as per Clause

17 of the order, it is obligatory in the part of the petitioner to get the permission within 30 days from the date of notice of the order, otherwise if so facto it will automatically stand cancelled.

3. Heard learned counsel for the parties and perused the documents.

4. It is directed that the petitioner shall make an application to Respondent No. 3 with all the relevant documents within a period of 2 weeks from today, if such application is filed the same shall be decided within 30 days of the receipt of a copy of the representation, after considering the factual aspect prevailing in this case. It is the responsibility of the the petitioner to apprise the Respondent No. 3 about the order dated 19.12.2019.
