The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.191/2017 registered in Police Station Suhela, Dist. Balodabazar Bhatapara for offence punishable under section 354(a)(d) IPC & Section 8 of the Protection of Children from Sexual Offences Act, 2012.

As per the prosecution case, on 22/12/2017 while the prosecutrix was going to her field to keep watch of the crop, at that time the applicant who was on the other field followed her, thereafter gagged her mouth caught hold of her by waist and her chest, having resisted and raised alarm the applicant fled away, thereby the applicant tried to outrage modesty of the prosecutrix.

Learned counsel for the applicant submits that charge sheet has been filed in this case, no further investigation is necessary, applicant is in jail since 23/12/2017, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Perused the statement of the victim. Considering her statement, degree of allegation and also considering the facts and circumstances of the case, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
