1. Learned counsel appearing for the petitioner submits that the petitioner is a widow of late Kamla Prasad who died in harness on 26.08.2009 while working with the respondents. According to petitioner, after death of her husband, she moved an application for compassionate appointment on 03.02.2011, however the Respondent authorities have not considered the said application till date.

2. Learned counsel for the Respondent submits that infact there is no application of the petitioner dated 03.02.2011 with the respondent, the only application which is pending consideration before the respondent is the application dated 31.07.2013 which is under active consideration with the respondent and the

respondents shall take a final decision on the said application in accordance with rules governing the respondent's establishment.

3. In the light of above submissions made by the Respondent, this petition is disposed of with a direction to the respondent to take a decision on the application for grant of compassionate appointment as early as possible preferably within a period of four months from today.

4. It is made clear that this court has not expressed any opinion on the merits of the claim of the petitioner so far as her entitlement on compassionate appointment is concerned and the respondent authority would be at liberty to take appropriate decision strictly in accordance with rules governing the respondent's establishment.
