Heard on I.A. No.1/17, which is an application for condonation of delay.

On due consideration and for the reasons stated in the application, the same is allowed and the delay of 68 days in filing the appeal is condoned.

Also heard on application for grant of leave to appeal. Perused the statement of the complainant as also para 18 of the judgment.

Considering the same, application for grant of leave to appeal is allowed.

Registry is directed to register the case as Acquittal Appeal.

Respondents are already represented, therefore, no further notice is required.

Learned counsel for the respondent submits that the respondent is still in jail.

In view of this, it is further directed that as and when the respondent is released from jail or otherwise, the same shall be informed to the Court by a suitable application and

thereafter the respondent shall furnish bail bond of Rs.25000/- and surety in the like sum within a period of two months from his release before the trial Court so that presence of respondent can be procured before this Court as and when required.

List it after four weeks.
