Petitioners are claiming entitlement to receive the amount of gratuity, which was deposited in the account of Rajesh Singh, the deceased father of the petitioner Nos.2 & 3, who died in harness on 23.10.2015.

It appears, there is dispute between the petitioners on the one side and the respondent No.2 on the other side for entitlement to the said amount of gratuity, therefore, it would be appropriate if the petitioners move before the jurisdictional Civil Court for obtainment of a succession certificate to receive the amount of gratuity lying in the account of Late Rajesh Singh. 3.

The petitioners may move before the jurisdictional Civil Court within a period of 2 months from today. If such application is filed for obtainment of succession certificate, the same shall be decided expeditiously after hearing all the affected parties. 4.

The writ petition stands disposed of.
