The applicant has preferred this third bail application under Section 439 of CrPC, as he has been arrested in connection with Crime No.29/2017, registered at Police Station Janakpur, District Korea, for the offence punishable under Sections 147, 149, 456, 354 (Ka), 323, 506, 375 (Kha), 376 (Gha), 450 and 201 of IPC. 2.

While rejecting the earlier bail application on 11.12.2017 in MCRC No.5963/2017, liberty was reserved in favour of the applicant to move again after examination of the prosecutrix or after 3 months, whichever is earlier.

The prosecutrix has already been examined before the trial Court, her deposition has been annexed with this bail application. 4.

Considering the liberty allowed in favour of the applicant and all other facts and circumstances of the case, including the deposition of the prosecutrix, this Court is inclined to release the applicant on bail. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
